Service Modifications

We reserve the right to modify or discontinue, temporarily or permanently, any service with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of any service.

Fees and Payment Terms

All fees for services will be outlined in your project proposal or contract. Payment terms may vary based on the specific services provided.

• Payment is due according to the terms specified in your agreement
• Late payments may be subject to interest charges
• All fees are exclusive of taxes, which will be added to your invoice
• We reserve the right to suspend services for unpaid invoices

Refund Policy

Refund policies vary by service type and will be specified in your service agreement. Generally, custom work and digital products may have limited refund eligibility once work has commenced.

Ownership Rights

Unless otherwise specified in writing, all intellectual property rights in the work product created by Nex Arc shall be assigned to the client upon full payment of all fees. Nex Arc retains the right to display the work in our portfolio and marketing materials unless otherwise agreed.

Client Materials

The client warrants that any materials provided to Nex Arc do not infringe on any third-party rights and that the client has the necessary permissions for their use.

License to Use

By providing materials to Nex Arc, the client grants us a limited license to use, reproduce, and modify such materials solely for the purpose of providing the requested services.

In no event shall Nex Arc, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the services
• Any conduct or content of any third party on the services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from our services
• Any bugs, viruses, Trojan horses, or the like that may be transmitted to or through our services

Our total liability to you for all claims arising out of or relating to these terms or your use of our services shall not exceed the amount paid by you to us in the six months preceding the claim.
